  • The CDM Regulations were introduced to try and reduce the number of injuries and fatalities on construction sites.
  • The Regulations place strict duties on four key parties:
    • the client,
    • the designer
    • the planning supervisor
    • the contractor
  • The Planning Supervisor co-ordinates the health and safety aspects of the project from design to the work starting.
  • Planning Supervisor also produces Health & Safety documents at tender stage and on completion of the works.
  • Failure to comply is a criminal offence.

 

The exact title of the CDM Regulations is, the Construction (Design and Management) Regulations 1994, which were introduced to try and reduce the number of fatalities and injuries on building sites.

By its nature, building work can be hazardous and good management of Health and Safety is essential to prevent accidents. Construction work is widely defined under the CDM Regulations and these apply to many different Projects.

The CDM Regulations place duties on four key parties to co-ordinate and manage health and safety throughout all the stages of a construction project.

The client  who has to ensure that only competent people design and carry out the work, and who must appoint a Planning Supervisor.

The designer  who should ensure that the work is designed to minimise the risk to health and safety during construction and when the building is in use.

The planning supervisor  who has overall responsibility for co-ordinating the health and safety aspects of the design, and specification, and in the selection of the contractor. His role is vital in the early stages of the project.

The contractor  who must take account of health and safety when preparing tenders and carrying out the work on site.

The Planning Supervisor has to co-ordinate the health and safety aspects of the project from initial design to the contractor starting on site. He also advises the client on the competence of contractors, and produces a Health and Safety Plan at the Tender stage highlighting the possible dangers involved in the proposed construction. At the end of the project the Planning Supervisor is responsible for the completion of the Health & Safety file, which contains information regarding all the materials and techniques used in constructing the project.

 

Failure to comply is a criminal offence

Failure to comply with the CDM Regulations is a criminal offence and if there were an accident those involved, including the client, could be prosecuted.
